DECREE

MINIMUM WAGE PROVISIONS OF LABOR REGION VIETNAM WORKING FOR ENTERPRISES WITH FOREIGN INVESTMENT, AGENCIES AND FOREIGN INSTITUTIONS, INTERNATIONAL ORGANIZATIONS AND INDIVIDUALS OF FOREIGNERS IN VIETNAM

Pursuant to the Law on Government Organization December 25, 2001;

Pursuant to Labor Code of June 23, 1994 Law amending and supplementing some articles of the Labor Code April 2, 2002 Law amending and supplementing some articles of the Labor Code on 29 June 2006;

Pursuant to businesses November 29, 2005;

At the proposal of the Minister of Labour, Invalids and Social Affairs,

DECREES:

Article 1. Regional minimum wage

Minimum wage to pay for the Vietnam Labor as the most simple tasks under normal working conditions for enterprises with foreign investment agencies, foreign organizations, international organizations and foreign individuals in Vietnam (hereinafter referred to as enterprises) by region as follows:

1. Level of 1.55 million VND per month applicable to enterprises operating in the area of region I.

2. Level of 1.35 million VND per month applicable to enterprises operating in the area of region II.

3. Level of 1.17 million VND per month applies to companies operating in the area of region III.

4. Level of 1.1 million VND per month applies to companies operating in the area of Region IV.

Article 2. Areas apply the minimum wage specified in Annex I and Annex II attached to this Decree.

Article 3. Applicable regional minimum wage

1. Minimum wage specified in Article 1 of this Decree is used to calculate the wage scale salary, various allowances, the salary stated in the labor contract, made preparations by the construction business and issued by the competent French Labour Code provisions.

2. Lowest wage paid to workers who received vocational training (including labor training by enterprises themselves) must be at least 7% higher than the regional minimum wage specified in Article 1 of this Decree.

3. Encourage enterprises to implement minimum wages higher than the regional minimum wage specified in Article 1 of this Decree.

4. Pursuant to the minimum wage specified in Article 1 of this Decree, enterprises adjust wages in the labor contract accordingly.

Article 4. Organization of implementation

Ministry of Labour, Invalids and Social Affairs shall coordinate with the General Confederation of Labor, the Vietnam Chamber of Commerce and Industry of Vietnam, the ministries concerned and the People's Committees of provinces and cities under the central government propaganda, disseminated to employees, employers and examine and supervise the implementation of regional minimum wage provisions of this Decree.

Article 5. Takes effect

1. Minimum wage specified in Article 1 of this Decree shall apply as follows:

a) The areas specified in Appendix I to this Decree perform May 01 from 01 in 2011.

b) The area is adjusted to apply the minimum wage specified in Annex II attached to this Decree implemented from July 1, 2011.

2. Repeal of Decree No. 98/2009/ND-CP October 30, 2009 of the Government the minimum wage for employees working in Vietnam for an enterprise with foreign capital investment, agencies and organizations foreign organizations, international organizations and foreign individuals in Vietnam.

3. The ministers, heads of ministerial-level agencies, heads of Government, President's Committee of provinces and cities directly under the Central Government and other agencies, enterprises shall implement this Decree. / .
